Our goal is to provide you with a personalized online and in-app experience that provides you with the information, resources, and services that are most relevant and helpful to you. This Privacy Policy has been written to describe the conditions under which our website, applications and other online services are being made available to you. This Privacy Policy discusses, among other things, how data obtained during your visit to our website and your use of our applications and other online services may be collected and used. This Privacy Policy also discusses important limitations about the way you may use materials and services you find on our website and as a result of using our applications and other online services. We strongly recommend that you read this Privacy Policy carefully. By using our website, our applications and other online services, you agree to be bound by the terms of this Privacy Policy. If you do not accept the terms of this Privacy Policy, you are directed to discontinue accessing or otherwise using the website, our applications, our other online services, or any materials obtained from any of them. If you are dissatisfied with any of our website, applications or other online services, then by all means contact us at support@snap4that.com; otherwise, your only recourse is to disconnect from the website or to stop using such application or other online service, and to refrain from visiting the site or using such application or online service in the future.

To achieve our goal of providing you with excellent services, we may need to collect information about you when you visit our website or use our applications or other online services. When you visit our site or use our applications or other online services, you may be providing RacerX with information about your visit or use on two levels:

Aggregated statistics collected as you browse our web site and/or use our applications or other online services. Organizational and personal information you knowingly give us.

Because RacerX respects your right to privacy, we want you to be aware of how we handle this information. We protect your personal information using industry-standard safeguards. We may share your information with third parties: (1) where necessary to carry out your instructions; (2) as necessary in order to provide you with the services or functionality offered by our sites, applications and other online services; (3) as necessary to enforce our then-current Terms of Use, if any, or to protect the rights, property, or safety of RacerX, its customers, and the public; or (4) as required by law.

GENERAL TERMS

Sites and Services Covered by this Privacy Policy

This Privacy Policy applies to all websites, domains, software, applications, offerings, information portals, online services and registries maintained from time to time by RacerX (as applicable, the “site(s)”, “website(s)”, “application(s)” and/or “services”, and collectively, the “Services”).

Changes to this Privacy Policy

The process of maintaining websites, applications and other online services is an evolving one, and RacerX may decide at some point in the future, without advance notice, to modify this Privacy Policy by posting a new Privacy Policy at this site and noting the date upon which the new Privacy Policy is effective and/or by sending you an email with the new terms. Please review any changes to our Privacy Policy carefully. If you agree to the terms of this Privacy Policy, simply continue to use the Services. If you object to any of the changes to the Privacy Policy, please do not continue to use our Services, as your continued use of our Services after we’ve posted a notice of changes to this Privacy Policy shall constitute your consent to the changed terms or practices.

Children’s Privacy

RacerX is committed to protecting the privacy needs of children, and we encourage parents and guardians to take an active role in their children’s online activities and interests. RacerX does not intentionally collect personal information from children under the age of 13, and RacerX does not target its services to children. Only persons who are more than 18 years old or who are emancipated minors may use our Services. By accessing our Services, you are legally acknowledging that you are over the age of 18 or an emancipated minor. Otherwise, you have no legal right to access or use our Services.

California Privacy and Do-Not-Track Laws

California residents who provide personal information in obtaining products or services for personal, family or household use are entitled to request and obtain from us, once per calendar year, information about the customer information we shared, if any, with other businesses for their own direct marketing uses. If applicable, this information would include the categories of customer information and the names and addresses of those businesses with which we shared customer information for the immediately prior calendar year. To obtain this information from us, please send us an email with “Request for California Privacy Information” as the subject of your message, and we will send to you a reply e-mail containing the requested information. Not all information sharing is covered by the “Shine the Light” requirements, and only information on covered sharing will be included in our response.

Please note that RacerX does not respond to “do not track” signals or other similar mechanisms intended to allow California residents to opt-out of Internet tracking.

Security

We have implemented industry-standard security safeguards designed to protect the personal information that you may provide. Access to your personal data on RacerX’s Services may be protected by user token authentication and other identity and access management tools, and sensitive data protected by SSL encryption when it is exchanged between your web browser and our Services. We also periodically monitor our system for possible vulnerabilities and attacks, consistent with industry standards. You should be aware, however, that since the Internet is not a 100% secure environment, we cannot ensure or warrant the security of any information that you submit to our Services. There’s also no guarantee that information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards. It’s your responsibility to protect the security and integrity of your account details. Please note that emails, instant messaging, and similar means of communication with other users of RacerX, if any, may not be encrypted, so you should not communicate any confidential information through these means.

Links to Third Party Websites and Services

RacerX’s Services may provide links or other connections to third-party websites, applications and other online services for the convenience of our users. If you access those links or other connections, you will leave RacerX’s Services. RacerX does not control these third-party websites, applications or other online services, and cannot represent that their policies and practices will be consistent with this Privacy Policy. For example, other websites may collect or use personal information about you in a manner different from that described in this Privacy Policy. Therefore, you should use other websites, applications and other online services with caution, and you do so at your own risk. We encourage you to review the privacy policy of any website, application or other online service before submitting personal information.

We may receive information when you use your account to log into a third-party site, application or other online service in order to recommend tailored content or advertising to you and to improve your user experience with our Services. We may provide reports containing aggregated impression information to third parties to measure Internet traffic and usage patterns.

TYPES OF INFORMATION WE COLLECT

Non-Personal Information

Non-personal information is data about usage and service operation that is not directly associated with a specific personal identity. RacerX may use non-personal data that is aggregated for reporting about the usability, performance, and effectiveness of our Services. It may be used to improve the experience, usability, and content of our Services. RacerX may automatically receive and record information on our server logs from your browser or mobile platform, including your location, IP address, browser type, operating information, mobile carrier, device and application IDs, cookie information, and any API you may use. By continuing to use our Services, you consent to our use of cookies, pixels and local storage and other data collection technologies in accordance with this Privacy Policy.

Aggregate Information

RacerX may gather aggregate information, which refers to information your computer automatically provides to us and that cannot be tied back to you as a specific individual. Examples include referral data (i.e., the websites you visited just before and just after our site), the pages viewed, time spent at our website or using our applications or other online services, and Internet Protocol (IP) addresses. An IP address is a number that is automatically assigned to your computer whenever you access the Internet. For example, when you request a page from one of our sites, our servers log your IP address to create aggregate reports on user demographics and traffic patterns and for purposes of system administration. RacerX may share non-personally identifying information in the aggregate, and RacerX’s analysis thereof, with third parties, such as the media, industry observers, customers, potential customers or partners.

Log Files and IP Addresses

Every time you access our Services, such as by requesting or downloading a file from the website or by using our application to register a product you acquired, RacerX may store data about these events and your user token, IP address and host name in a log file. We may use this information to analyze trends, administer the Services, track users’ movements, and gather broad demographic information for aggregate use or for other business purposes. When you access or leave our site by clicking on a hyperlink, we receive the URL from the site from which you last visited or the one to which you’re directed. We may receive the IP address of your computer or proxy server used to access the applicable Service, your operating system, the type of browser you used, and the type of device and/or operating system you use, mobile device identifiers (such as user tokens), your mobile device carrier or your ISP. We also may receive location data passed to us from third-party services or GPS-enabled devices that you have set up in order to customize your experience based on location information.

Cookies

We use cookies and similar technologies, including mobile device identifiers, to help us recognize you when you log into our site or use our other Services. By accessing the site or using our other Services, you are consenting to the placement of cookies and other similar technologies in your browser in accordance with this Privacy Policy and our Terms of Use. Cookies are small packets of information that a site’s, application’s or other online service’s computer stores on your computer. RacerX can then read the cookies whenever you visit our site or use our other Services. We may use cookies in a number of ways, such as to save your account information so you don't have to re-enter it each time you visit our site or use our other Services, to deliver content specific to your interests and to track the pages you've visited or the portions of the other Services that you have accessed and used. These cookies allow us to use the information we collect to customize your experience so that your visit to our site and use of our other Services is as relevant and as valuable to you as possible. You may modify and control how and when cookies are set through your browser settings. Most browsers offer instructions on how to reset the browser to control or reject cookies in the “Help” section of the toolbar. If you choose to reject cookies, certain of the functions and conveniences of our Services may not work properly, and you may be unable to use those of our Services that require registration in order to participate, or you will have to re-register each time you visit our site or use our other Services.

Web Beacons

The Services also may use web beacons and other technologies, such as pixels and ad tags, to collect non-personal information about your use of our Services and the sites, applications and other online services of selected partners, affiliates, sponsors or resellers, your use of special promotions or newsletters, and other activities. The information collected by web beacons allows us to statistically monitor how many people are using our Services and the sites, applications and other online services of selected partners, affiliates, sponsors or resellers; how many people open our emails; and for what purposes these actions are being taken. We do not share personally identifiable information obtained from web beacons with any third-party advertisers, but we may show you sponsored content from our partners and affiliates. Our web beacons are not used to track your activity outside of our Services or those of our partners, affiliates, sponsors or resellers.

Clickstream

The Services may allow for the use of clickstream data collection. Clickstream analysis is the process of collecting, analyzing, and reporting aggregate data about which pages visitors visit in what order based on mouse clicks each user makes. Clickstream analysis is useful for web activity analysis and other functions that help us to understand how you use our Services. We may provide our users’ aggregated, non-personal clickstream data to third parties for marketing and other business purposes.

New Technologies

As new technologies emerge, RacerX may be able to improve our Services or provide you with new ones, which means that RacerX may create new ways to collect information on the site and our other Services. If we offer a new Service or new features to our existing Services, for example, these changes may result in our collecting new information in order to improve your user experience.

Location Information

When you use a location-enabled device, we may collect and process information about your actual location, like GPS signals sent by a mobile device. We also may use various locations to determine location, such as sensor data from your device that may, for example, provide information on nearby Wi-Fi access points and cell towers.

Personal Information

Personal information is information that is associated with your name or personal identity. RacerX uses personal information to better understand your needs and interests and to provide you with better service. On some of our Services, you may be able to request information, subscribe to mailing lists, participate in online discussions, collaborate on documents, provide feedback, submit information into registries, or register products, or apply for membership. The types of personal information you provide to us via the Services may include name, address, phone number(s), e-mail address, product information on products you have purchased (including, without limitation, brand, model number, and product serial numbers and control codes). RacerX may use personal information to provide services that support the product registration activities and other activities of our members.

Registration

In order to use some features of the RacerX website and other Services, you need to create an account by providing us with at least your name, email address and telephone number(s). We encourage all visitors to our website to register with RacerX and to download and register to use our applications and other online services, although registration is not required to visit our site. Your name, address, telephone number(s), and email address may be used to send you information about our company, product and Services updates, special offers, and newsletters. You agree to allow RacerX to use this information in accordance with this Privacy Policy and our then-current Terms of Use, if any.

If you register with and use our Services, we will securely collect your contact information and product registration information. The contact information that you provide to us will be used for product registration and may be shared with our partners if that is necessary to fulfill your request. During the registration process, you may be given the opportunity to sign up for future e-mailings regarding our products, services, and promotions.

HOW WE USE YOUR PERSONAL INFORMATION

By using our Services, you consent to our use and dissemination of your personal information consistent with the terms of this Privacy Policy.

Consent to Use by RacerX

Except as provided in this Privacy Policy, we do not sell or rent or otherwise share your personal information without your consent.

RacerX may use personal information to provide services that support the activities of our organization. When accessing the site or using the other Services, we may track your personal user information in order to support your product registration activities, ensure authorized access, and enable communication between users and us and between users and our partners and affiliates.

The personal information you may provide to RacerX may reveal or allow others to discern aspects of your life that are not expressly stated in your account information (for example, your product purchasing/registration history may reveal information about your age or your gender). By providing personal information to us when you create or update your account or you otherwise use our Services, you are expressly and voluntarily accepting the terms and conditions of our Terms of Use and freely accepting and agreeing to our processing of your personal information in ways set out by this Privacy Policy. Supplying information to us, including any information deemed “sensitive” by applicable law, is entirely voluntary on your part. You may withdraw your consent to RacerX’s collection and processing of your information by closing your account. You should be aware that if you close your account your account information and purchasing/registration information may continue to be maintained by RacerX in accordance with this Privacy Policy and our then-current Terms of Use, if any.
 Communications from RacerX

We use the information you provide to customize your experience on our site and your experience using our other Services. We may communicate with you via the Services or using email or other means available to us regarding the availability of our Services, service-related issues, or promotional messages that we believe may be of interest to you. We may, for example, send you welcome messages, emails regarding new features or services, and other promotional information from RacerX, or our partners and affiliates. You may opt out of receiving promotional messages from RacerX by following the instructions contained in the email. As long as you're a registered user, however, you can’t opt out of receiving service messages from us. RacerX may also use personal information in order to customize content on the site or on the other Services for you, such as products, services and news relevant to you or to your industry or to RacerX. Our partners and affiliates also may use such contact information to contact you directly with information on their own products, services, and offers. We will not provide our partners with any credit card or billing information. By providing us with your personal information when you access our site and use our other Services, you are agreeing to the terms of this Privacy Policy, and you expressly consent to our storing, processing, and distributing your information for these purposes.

RacerX also may disclose personal information that is associated with your account as permitted by law or as reasonably necessary to: (1) comply with a legal requirement or process, including, but not limited to, civil and criminal subpoenas, court orders or other compulsory disclosures; (2) investigate and enforce this Privacy Policy or our then-current Terms Use, if any; (3) respond to claims of a violation of the rights of third parties; (4) respond to customer service inquiries; (5) protect the rights, property, or safety of RacerX, our users, or the public; or (6) as part of the sale of the assets of RacerX or as a change in control of the organization or one of its affiliates or in preparation for any of these events. RacerX reserves the right to supply any such information to any organization into which RacerX may merge in the future or to which it may make any transfer. Any third party to which RacerX transfers or sells its assets will have the right to use the personal and other information that you provide in the manner set out in this Privacy Policy.

We may monitor or record any of your telephone conversations, emails, or chats with us for quality control purposes, for purposes of training our employees, and for our own protection.

DATA PROTECTION

The site and the other Services are intended for use by residents of the United States of America only, and all matters relating to the site and to our other Services are governed by the laws of the United States. Given the international scope of Internet access, your personal information may be visible to persons outside your country of residence, including to persons in countries that your own country’s privacy laws and regulations deem deficient in ensuring an adequate level of protection for such information. If you are unsure whether this Privacy Policy is in conflict with applicable local rules, you should not submit your information. If you are located within the European Union, you should note that your information will be transferred to the United States, which is deemed by the European Union to have inadequate data protection. Nevertheless, in accordance with local laws implementing the European Union Privacy Directive on the protection of individuals with regard to the processing of personal data and on the free movement of such data, individuals located in countries outside of the United States of America who submit personal information do thereby consent to the general use of such information as provided in this Privacy Policy and to its transfer to and/or storage in the United States of America. By utilizing the site or the other Services and/or by directly providing personal information to us, you hereby agree to and acknowledge your understanding of the terms of this Privacy Policy, and consent to have your personal data transferred to and processed in the United States and/or in other jurisdictions as determined by RacerX, notwithstanding your country of origin, or country, state and/or province of residence. If you do not want your personal information collected and used by RacerX, please do not visit our website or use our other Services.

We also may retain indefinitely non-personally identifiable, aggregate data to facilitate our ongoing operations.

Your Obligations

You must not upload or otherwise disseminate any information that may infringe on the rights of others or that may be deemed to be defamatory, injurious, violent, offensive, racist or xenophobic, or that may otherwise violate the purpose and community spirit of RacerX or its users.
